It does. With same window height it changes available space for file list and height of the gap depends on it. And since those elements have different heights themselves, it's unlikely that the gap would be always the same no matter if they are visible or not.

First line of images shows how it is now. Second line are possible solutions:
1) Reduce the list height for perfect fit. But it would waste space below with exactly the same height as previous gap was.
2) Don't insist on alignment for first visible item in the list and allow it to be partially hidden.
3) Keep the first item aligned, don't care about the last item in list and leave it partially hidden. But it would be wrong, because it would make it inaccessible (unless combined with 2)

There is indeed a gap BEHIND the last file, because otherwise the last file would be only partially visible. The first visible file in the list is always fully visible, so when the height of the list isn't an exact multiple of a single item, the last item would be either partially shown, or there will be a gap of that size.
However, there should be no gap as soon as you scroll up at least one line.
