This problem has been fixed in Total Comander 8.0ß9 32-bit and 64-bit by making sure Total Commander behaves like this:

In case the user has switched off the Windows recycle bin confirmation dialogue and not set the parameter VistaDelete at all, Total Commander will assume VistaDelete=0 should be used. Result: Total Commander will ask for confirmation before deleting to the recycle bin.

In case the user has left the Windows recycle bin confirmation dialogue switch on (Windows default) and not set the parameter VistaDelete at all, Total Commander will assume VistaDelete=1 should be used. Result: Windows will ask for confirmation before deleting to the recycle bin.

Explicitly setting VistaDelete=1 inside the wincmd.ini file will override the default behaviour, assuming the user knows what he is doing.

Note:
VistaDelete is only meaningful on Windows Vista or newer.

So I assume this thread can be moved to the Fixed Bugs section.
