The new rubberband selection
Here are my observations for the new rubberband selection.
1. When using a column view it works just like in Explorer. I don't like the destructive nature of this selection. For me starting a rubberband selection from the space after the filename and using destructive selections are independent. As other may prefer the Explorer behavior it's a candidate for an option.
2. In thumbnail mode it's really strange to have a rubberband but select also other items not covered by the rubberband. In addition selection cannot be started between the items. Sometimes items below the rubberband are not selected. Clicking anywhere doesn't seem to remove the selection...
I'm not even sure what exactly the intended behavior is so I didn't post a bug report.
Technically it seems to work very good - just using themes here would be nice.

The alternate way would be 'the selection state of the first item is inverted and forwarded to all other items in the selection" which is the same logic as in right click selection.How should it work then? It just selects what is covered by the rectange now.

That's a good question. I'm not aware of the parts/states. You are already drawing a nice semi-transparent rectangle. Adding a border would improve it even more.Are there themes for rubberbands?

I also think a one pixel border like Explorer does it would be nice. IMO the colour of the rubberband should be cusomizeable to match the different pane colours. It's only active in left mouse button selection mode. Then start a drag&drop operation behind a file name.

Another conceptual issue is that it behaves differently at the same position depending on whether the item is selected or not. So when you create a rubber band selection by clicking behind a filename and enlarge the rubberband in order to select a files all is fine. Then you want to remove a few filse from the selection by creating another rubberband. Now there is the problem: TC wants to drag the files? Is this intentional?

Not quite. In Explorer you can still create a new rubberband from left or right of the columns - and this area is well defined as the selection is displayed always as a frame...I do this because the Explorer does the same!
Anyway. I have no problem if TC provides a selection style that mimics Explorer's. I just want something that is more TC selection style but reserves the right mouse button for the context menu.

That's because the Explorer doesn't select the entire line.Not quite. In Explorer you can still create a new rubberband from left or right of the columns

I created a wiki table which analysis the current selection modes and what I would prefer. This should be called a 'custom selection mode' which is fully customizable.

I would like to suggest to expand your table with the following entries:
1. Select single file(s) (CTRL + click on a file)
2. Select contiguous files *)
3. Multiple marking of file(s) (multiple separate groups of contiguous files)

Personally, I'm fine with right mouse button selection mode - but with regard to your suggestion "Custom selection style" -
