I don't think EULAs are very worthy :D , but they are part of the contract. And sure you are right, that not all of parts of the EULA will be enforceable but I doubt that you can say they're generally invalid.
E. g. you can give back the OEM Version of Windows if it is bundled with an PC and you do not agree with the EULA.

The EULA of Windows has no legal meaning in Germany because it is not known when buying the product and so it's NOT part of any contract.

No need to discuss facts, sorry.

Thanks for the links. I already have the first one, but it can't open the file because it's packed. I will check the other two out and see if they'll open totalcmd.exe...
