Create directory old with two text files: file1 and file2.

Copy old directory to new.

Open old in the left panel, new in the right panel.

Use Find... in the right panel to select file2 and then press Feed to listbox.

Now there are 2 files on the left and 1 file on the right.

Compare by content... for old\file1 shows message box "The two files have the same content!" - but there is no file1 on the right.

Change new\file2 by editing so it's definitely different from the old\file2.

Compare by content... works from the right panel for file2, but tells "The two files have the same content!" for file2 from the left.

By default, the compare tool looks for a file with the same name in the directory of the other panel when nothing is selected there. That's why it compares the file1 with the same name file in new.

It is acceptable as an explanation for file1 (as a feature).

I do not see how it explains the last two sentences in the opening post. That is:

Change new\file2 by editing so it's definitely different from the old\file2.

Compare by content... works from the right panel for file2, but tells "The two files have the same content!" for file2 from the left.

The word works should be understood as you see ordinary compare window with the differences displayed in red.
